Marijuana Crimes Attorney in San Francisco

The approval of medical marijuana laws in California has resulted in a lot of confusion about what is and isn't legal in terms of growing, possessing and selling marijuana. We defend people who were arrested, charged and jailed for alleged marijuana crimes. We also offer advice to medical marijuana grow houses, dispensaries and transporters who have questions about California's Compassionate Use Act, the Medicinal and Adult-Use Cannabis Regulation and Safety Act, or who face prosecution for marijuana cultivation, distribution or transportation.

We work with individuals who face charges on any of these:

  • Marijuana, heroin, cocaine, or methamphetamine offenses
  • Drug dealing cases
  • Possession of drugs or drug paraphernalia
  • Prescription drug charges

A drug arrest can have serious consequences on your personal and professional life. An established and well-respected attorney like Angeli Fitch often can resolve the matter without going to trial, saving her clients time, money and a lot of headaches.

If you face charges regarding the possession, sales or manufacturing of marijuana, cocaine, heroin, crack, methamphetamine or any other drug, our experienced San Francisco drug crime lawyer can help. Call or email us to schedule a free consultation.

Marijuana DUI And Other Crimes In San Francisco

It is unlawful to drive while under the influence of marijuana (or alcohol or any other drug). "Under the influence" is not specifically defined in the state statute, but is interpreted to imply some degree of impairment. For evidence of impairment, officers may administer a field sobriety test. Arrestees may also be required to submit to their choice of a urine or blood test.

Generally, most urine and blood tests can only test for the presence of marijuana metabolites. These metabolite levels, however, may only show that marijuana has been administered at some point in the past, but they do not always prove that you were under the influence at the time of your arrest or citation. In addition, there are also several studies that show that marijuana use does not raise your risk of road trauma. Experienced attorney Angeli Fitch is skilled in the art of Marijuana DUI defense and can help you obtain justice.

Any individual under 21 who is convicted of a marijuana, alcohol or other drug offense faces a 12-month driver's license suspension, regardless of whether the offense was driving-related. This penalty can be avoided by entering a diversion program. In fact, we are often able to obtain reduced or dismissed charges, keep our clients out of jail and have illegally seized money returned to its rightful owners.

Additionally, some marijuana-related felony convictions may be subject to expungement so that you can ultimately clear your record.

If you face charges of driving under the influence of marijuana or any marijuana offense, call or email us. We will explain your options and aggressively protect your freedom.
